These Terms of Use ("Terms") are a binding agreement between you ("User," "you") and Sakhaout Hoshen, the individual developer and publisher of the Solar Exodus application ("Developer," "we," "us"), governing your download, installation, and use of the Solar Exodus application (the "App"). By installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not install or use the App.
These Terms are provided by Developer as the "EULA" required under the Solana Mobile dApp Store Developer Agreement and are intended to comply with the Solana Mobile dApp Store Publisher Policy. Nothing in these Terms limits any rights you may have against Solana Mobile, Inc. under the separate terms governing your use of the Solana Mobile dApp Store itself.
Solar Exodus is a single-player, browser-engine-based (WebGL/Three.js) space-survival arcade game distributed as a native application through the Solana Mobile dApp Store. Gameplay consists of piloting a spacecraft, mining ore, avoiding or destroying hostile entities and asteroids, and upgrading technology before an in-game star ("the Sun") collapses. The App currently has no in-app purchases, no advertising, and does not mint, trade, or transfer any token, NFT, or other digital asset.
You must be at least 13 years old, or the minimum age of digital consent in your jurisdiction, to use the App. If you are under the age of majority in your jurisdiction, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
Subject to your compliance with these Terms, Developer grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a compatible device that you own or control, solely for your own personal, non-commercial entertainment. This license does not grant you any ownership interest in the App, its code, or its content.
4.1. On launch, the App may prompt you to connect a Solana-compatible wallet through your device's native wallet bridge. The App requests only your wallet's public address to gate entry into gameplay. The App does not request, access, or store your private keys, seed phrase, or wallet credentials, and Developer never has custody of, or access to, your funds.
4.2. The App does not currently initiate, request, or require any on-chain transaction, token transfer, token mint, or signature for gameplay. If any such functionality is added in the future, it will only occur with your explicit, informed approval through your own wallet application, and these Terms will be updated accordingly.
4.3. You are solely responsible for the security of your wallet, private keys, and seed phrase, and for any transactions you choose to authorize through your wallet in connection with the broader Solana network. Developer is not responsible for any loss of digital assets resulting from your own wallet management, phishing, device compromise, or third-party wallet software.
4.4. Digital assets and blockchain technology carry inherent risk, including price volatility, network congestion, smart contract risk, and regulatory uncertainty. Nothing in the App or these Terms constitutes financial, investment, legal, or tax advice.

All title, ownership rights, and intellectual property rights in and to the App, including its name, code, artwork, audio, and other content, are and remain the exclusive property of Developer or its licensors. "Solar Exodus" and associated logos are marks of Developer. No rights are granted to you other than the limited license expressly set out in Section 3.
The App is currently free to download and play, with no in-app purchases or subscriptions. Developer reserves the right to introduce paid features, in-app purchases, or optional token-based functionality in the future, in which case such features will be clearly disclosed, will require your affirmative consent before any charge or transaction, and these Terms will be updated to reflect them.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. DEVELOPER DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, DIGITAL ASSETS, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. DEVELOPER'S TOTAL AGGREGATE LIABILITY ARISING OUT OF THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, TO DEVELOPER FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Developer from and against any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms, your misuse of the App, or your violation of any applicable law or third-party right.
These Terms remain in effect until terminated. Developer may suspend or terminate your access to the App at any time, with or without cause, including for violation of these Terms. You may terminate these Terms at any time by uninstalling the App. Sections 4, 6, 8, 9, 10, and 12 survive termination.
These Terms are governed by, and construed in accordance with, the laws of the People's Republic of Bangladesh, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the competent courts of Bangladesh, except where applicable law requires otherwise.
You agree not to use the App in any manner that would cause Developer to violate the Solana Mobile dApp Store Publisher Policy, including provisions relating to restricted content, prohibited activities, and user data handling. Developer reserves the right to remove, restrict, or update the App at any time to remain compliant with the policies of the Solana Mobile dApp Store.
Developer may update these Terms from time to time. Material changes will be reflected by an updated "Effective Date" above and, where required by law, additional notice will be provided. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between you and Developer regarding the App and supersede any prior agreements. Developer's failure to enforce any right or provision will not be deemed a waiver of such right or provision.
